Terms and Conditions

These Terms and Conditions apply to all current and future products and services offered by And Everything Nice, including custom cookies and any related products available through the website.
By placing an order, you agree to the following:
1. Placing an Order
Orders can be placed via the Shop page for standard products or the Custom Orders page for custom cookies.
All orders must be confirmed in writing, and full payment is required to confirm production.
Minimum notice for standard custom orders is 14 days. Larger or more detailed orders may require up to 4 weeks. Rush orders may be accepted subject to availability and may incur a rush fee.
2. Payment & Pricing
Payment methods vary depending on order type. Shop orders are paid securely via card at checkout. Custom orders are invoiced and payable via PayID.
All prices are in Australian Dollars (AUD) and include GST where applicable.
Orders are only confirmed once full payment has been received. For invoiced orders, payment is due within 24 hours unless otherwise stated. Failure to pay within this timeframe may result in cancellation.
3. Delivery & Pick-Up
Pick-up is available from Footscray, Melbourne VIC 3011 by appointment.
Australia-wide delivery may be available at an additional cost depending on location and order size.
Once an order has been collected by the customer or handed to a courier, responsibility for the goods transfers to the customer or delivery provider. And Everything Nice is not responsible for delays, damage, or loss after dispatch or collection.
Pick-up times must be agreed in advance. If you are unable to collect within the agreed time, you must provide notice. Failure to collect within 24 hours without arrangement may result in cancellation without refund.
4. Custom Orders
Custom cookies are made based on customer-provided details, themes, or references.
As each cookie is individually handcrafted, slight variations in colour, design, and finish are to be expected.
By placing a custom order, you acknowledge and accept the nature of handmade products.
5. Cancellations, Refunds & Store Credit
Due to the custom-made and perishable nature of products, cancellations are not permitted once an order has been confirmed.
Refunds are not provided for change of mind, missed pick-up, or courier delays.
If an order arrives significantly damaged in transit, contact must be made within 24 hours with photographic evidence for assessment.
Where applicable under Australian Consumer Law, you may be entitled to a replacement, refund, or store credit in the case of a major fault.
Store credit may be issued at discretion and is valid for 6 months from the date of issue.
If And Everything Nice is unable to fulfil an order due to unforeseen circumstances, a full refund or alternative arrangement will be offered.
6. Allergen Information
Products may contain or come into contact with allergens including dairy, eggs, gluten, and nuts.
While strict hygiene practices are followed, a completely allergen-free environment cannot be guaranteed.
Customers are responsible for informing the business of any allergies prior to ordering.
7. Use of Photos
And Everything Nice may photograph completed products for marketing and promotional use, including social media and website content.
8. Intellectual Property
All designs, images, and content created by And Everything Nice remain the intellectual property of the business and may not be used or reproduced without permission.
9. Limitation of Liability
And Everything Nice is not liable for any adverse reactions, misuse, or issues arising after consumption or collection of products.
Liability is limited to the value of the order.
10. Australian Consumer Law
Nothing in these Terms excludes your rights under Australian Consumer Law.
You are entitled to a replacement or refund where goods fail to meet consumer guarantees, including in the case of a major fault.
11. Privacy
Personal information is collected solely for order processing and communication purposes. Information will not be shared with third parties unless required by law.
12. Updates to Terms
These Terms and Conditions may be updated at any time. The most current version will always be available on this website.
